Terms of Service

Effective October 25, 2026

These Terms are a binding agreement between you and Stack AI (“we”, “us”) covering the Stack AI website, web app and mobile apps for iOS and Android (together, the “Service”). By creating an account, starting a trial or using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. Who can use Stack AI

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract. You’re responsible for your account, for keeping your login secure, and for everything done with it. Tell us right away at support@joinstack.co if you think someone else has access.

2. What Stack AI is, and isn’t

Stack AI is a software tool for content creators. It helps you keep track of brand campaigns you get on your own, plan film sessions and posting times, send reminders to your calendar, edit and caption your videos, post them to the Instagram and TikTok accounts you connect, answer comments and messages with replies you set up, and estimate what you’ll earn.

  • Stack AI does not run, sponsor, fund or pay for any campaign, and today it isn’t an agency, marketplace, talent manager or employer. Any deal is between you and the brand or platform.
  • Optional services later. We may offer separate services in the future, such as agency, management or campaign services. They’d be optional, explained before you join, and covered by their own agreement that you’d have to accept. Nothing about how Stack AI works for you changes unless you sign up for one.
  • Earnings figures are estimates based on the terms and view counts you enter. We don’t guarantee approvals, views or payment.
  • Leads or listings shown in the pipeline may come from third parties. Read their terms before you apply.
  • Automatic edits and captions are generated by software and can make mistakes. Review your video before you post it.

3. Subscriptions, free trials and billing

  • Paid plans only. Using the Service requires an active subscription (Starter or Pro), monthly or yearly. Prices, plan limits and taxes are shown before you buy.
  • Free trial. New subscriptions may start with a free trial of the length shown at checkout. If you don’t cancel before the trial ends, your subscription starts and you’re charged the price shown. If you buy a subscription during a trial, any unused part of the trial ends when the paid period begins.
  • Automatic renewal. Your subscription renews automatically at the end of each period at the then-current price until you cancel. We’ll tell you before a price change, and it applies from your next renewal.
  • Cancel anytime. Cancelling stops the next renewal. You keep access until the end of the period you paid for.
  • Unlimited means fair use. “Unlimited” edits are for your own content as one creator. We may slow or limit automated, shared or abusive use, and we’ll contact you first.
  • Upgrades and downgrades take effect as shown at the time, with any proration displayed before you confirm.

If you subscribe on our website

Payments are processed by Stripe. Cancel online in Settings > Plan & billing at any time; you don’t need to contact us. Fees are non-refundable except where the law requires otherwise. If you were charged by mistake, email support@joinstack.co within 14 days and we’ll look at it in good faith. EU and UK consumers: by starting your subscription right away you ask us to begin during the withdrawal period, and any refund for withdrawing is reduced for the time already used.

If you subscribe in the iOS app (Apple App Store)

  • Payment is charged to your Apple ID account when you confirm the purchase.
  • Your subscription renews automatically unless it’s turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the current period ends.
  • You can manage or cancel your subscription in your Apple ID account settings after purchase (Settings > your name > Subscriptions).
  • Refunds are handled by Apple under Apple’s policies, at reportaproblem.apple.com.

If you subscribe in the Android app (Google Play)

  • Payment is charged to your Google Play account and is governed by the Google Play Terms of Service.
  • Your subscription renews automatically until you cancel it in the Google Play app (Profile > Payments & subscriptions > Subscriptions). Cancelling stops future renewals.
  • Refunds are handled by Google under Google Play’s refund policies.

Deleting the app or your Stack AI account does not cancel a subscription bought through Apple or Google. Cancel it in your App Store or Google Play settings too.

Failed payments. If a payment fails we’ll retry and let you know. If it can’t be collected, access pauses until it’s resolved. Your data isn’t deleted because of a failed payment.

4. Your content

You own the videos, audio, captions, text and other material you upload or create (“Your Content”). You give Stack AI a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transcribe, edit, render and display Your Content only to provide the Service to you. This license ends when you delete Your Content or your account, except for copies kept in backups for the short period described in our Privacy Policy. We don’t use Your Content to train AI models, sell it, or use it for advertising.

You’re responsible for having every right needed for what you upload, including music, footage, logos and the likeness of anyone in your videos, and for following each brand’s and platform’s rules.

5. Content rules and reporting

Don’t upload, create or share anything that is illegal, infringing, defamatory, harassing, hateful, violent or threatening, sexually explicit, sexualizes minors in any way, promotes self-harm, or is deceptive (for example fake reviews or undisclosed endorsements). We have zero tolerance for this content and for abusive users. To report content or a user, email support@joinstack.co with the details. We review reports within 24 hours and may remove content and suspend or terminate the account responsible.

6. Disclosures and platform rules

You’re responsible for clearly disclosing paid partnerships, gifted products and affiliate links as required by the FTC Endorsement Guides and similar laws, and for following the terms of TikTok, Instagram, YouTube and any other platform you post to, including any rules about posting the same content to several accounts.

Posting and replying for you (Autopilot)

When you connect an Instagram or TikTok account, you authorize Stack AI to act on that account only in the ways you set up: publish the videos you schedule, at the times you pick, and send the comment replies and direct messages your rules describe. You’re responsible for what gets posted and sent, for having the right to post it, and for following Instagram’s and TikTok’s rules, including their limits on automated messages. Disconnect an account at any time in Settings > Connected accounts; its scheduled posts and rules stop right away.

7. Acceptable use

Don’t: break the law or anyone’s rights; run spam, bot, fake-engagement or view-manipulation schemes; access the Service by automated means except through features we provide; probe, overload or interfere with it; reverse engineer it except where the law allows; share your account; or resell the Service without our written permission.

8. Affiliate program

If you share your referral link you may earn the commission shown in the app (a percentage of what your referrals pay, for a limited number of months). Commissions are earned only on paid, non-refunded payments, are held for a period before becoming payable, and are void for self-referrals, fraud, spam, paid search on our brand, or misleading promotion. You must disclose that you earn a commission when you share your link. You’re responsible for taxes on commissions and for giving us accurate payout and tax details. We may change or end the program with notice; commissions already earned stay payable.

9. Third-party services

The Service connects to third-party services such as Instagram (Meta), TikTok, Google Calendar, Stripe, the Apple App Store and Google Play. Your use of them is governed by their terms and privacy policies, and we aren’t responsible for them. You can disconnect integrations at any time.

10. Mobile apps

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Stack AI app on devices you own or control, for your own use, under these Terms.

Additional terms for the iOS app

If you downloaded the app from the Apple App Store, you and we agree that:

  1. Parties. These Terms are between you and Stack AI only, not Apple Inc. (“Apple”). Stack AI, not Apple, is solely responsible for the app and its content.
  2. License scope. Your license is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  3. Maintenance and support. Stack AI alone is responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support.
  4. Warranty. Stack AI is responsible for any product warranties not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the app. To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are Stack AI’s responsibility.
  5. Product claims. Stack AI, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  6. Intellectual property. If a third party claims the app or your use of it infringes their intellectual property rights, Stack AI, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
  7. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints or claims about the app go to Stack AI, support@joinstack.co.
  9. Third-party terms. You must comply with any third-party agreements that apply when you use the app, such as your wireless data service agreement.
  10. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Additional terms for the Android app

If you downloaded the app from Google Play, these Terms are between you and Stack AI, not Google. Google is not responsible for the app, and your use of Google Play is also governed by the Google Play Terms of Service.

11. Our intellectual property

The Service, including its software, design and branding, belongs to Stack AI and its licensors. Fonts, templates and other assets we provide may be used only within the Service and in the videos you export from it. If you send us feedback, we may use it freely.

12. Copyright complaints (DMCA)

If you believe something on the Service infringes your copyright, send a notice to support@joinstack.co identifying the work, the material and where it is, your contact details, a statement of good-faith belief, and a statement under penalty of perjury that the notice is accurate and you’re authorized to act, with your signature. We remove infringing material and terminate repeat infringers.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, STACKAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DOESN’T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT SCHEDULES, ESTIMATES, CAPTIONS OR EDITS WILL BE ACCURATE.

14. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, STACKAI ISN’T LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DEALS, CONTENT OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100. Some places don’t allow these limits, so they may not apply to you, and nothing in these Terms limits rights you have as a consumer that can’t be waived.

15. Indemnity

You’ll defend and indemnify Stack AI against third-party claims arising from Your Content, your deals, or your breach of these Terms or the law, except to the extent caused by us.

16. Ending your account

You can delete your account at any time inside the app (Settings > Account > Delete account) or as described on our Data deletion page. We may suspend or end your access for a serious or repeated breach of these Terms, non-payment, or legal risk, with notice where reasonable. Sections that by their nature should survive (such as 4, 11 to 15 and 17) survive termination.

17. Governing law and disputes

These Terms are governed by the laws of Virginia, USA, without regard to conflict-of-law rules. Before filing a claim, contactsupport@joinstack.co so we can try to resolve it informally within 30 days. Disputes go to the state or federal courts in Virginia, except that either side may use small-claims court, and consumers in the EU or UK may bring claims in their home courts.

18. Changes to these Terms

We may update these Terms. For material changes we’ll give at least 14 days’ notice by email or in the app before they take effect. If you don’t agree, cancel before the change applies; continuing to use the Service after that means you accept the new Terms.
